In addition to the rules and obligations set forth in the Rental agreement, when you use our electric scooters, you are required to abide by the rules set forth in these RIDER RULES FOR ELECTRIC SCOOTERS. We may at anytime revise these rules at our sole discretion and without prior notice. By using a Rodanthe Rides E-Scooter, you are deemed to have accepted and agreed to abide by the rules set forth below. Failure to abide by these RIDER RULES FOR ELECTRIC SCOOTERS or any part of the Rental Agreement may result in fines, penalties, and termination of your rental agreement.

**MUST BE 18 OR OLDER TO RENT OUR SCOOTERS**

1. ​Requirements to use Rodanthe Rides Electric Scooters 

a. You must be at least 16 years of age to drive our Electric Scooters. 

b. You must have a signed waiver on file to use our Electric Scooters.

c. You must be able to operate our Electric Scooter in a competent manner.

d. You know how to operate the Electric Scooter and are physically and mentally capable.

e. You understand that adverse weather conditions can impact the safe use of the Electric Scooter and ability to respond accordingly. This may mean not using the Electric Scooter due to weather conditions.

(We do our best to educate you on local laws governing how to use our electric scooters, please ensure that you have familiarized yourself with these laws as well, which you must follow when you use our electric scooters).

f. Do not use our Electric Scooters in prohibited areas, including but not limited to, all Skate Parks. Make sure you understand and obey the laws on sidewalk use, traffic, and parking. You are responsible for abiding by local traffic rules and regulations.

g. The “CUSTOMER” UNDERSTANDS AND AGREES THAT HIS/HER SIGNATURE BELOW CONSTITUTED EXPLICIT APPROVAL FOR RODANTHE RIDES LLC TO USE THE AUTHORIZED CREDIT CARD ON FILE FOR SECURITY HOLD TO PAY FOR ANY ADDITIONAL FEES OR BALANCES DUE UPON RETURN (I.E. ADDITIONAL RENTAL TIME, DAMAGES, LOSS OF USE, ETC.) A COPY OF ALL FINAL RECEIPTS WILL BE EMAILED TO THE RENTAL GUESTS EMAIL ON FILE.

2. Prohibited use/Restrictions of use with Rodanthe Rides E-Scooters.

a. You cannot carry a passenger or animal on a scooter. Aside from simply exercising caution and good judgment, you should not carry any items (like a briefcase or a bag) or use any device (like a cell phone or other portable device) if they could impair or hinder safe use (For example, no texting while using our electric scooters).

b. Do not use our Electric Scooters if you are under the influence of any drugs, alcohol, or any other substance that impair your ability to safely operate the electric scooter.

c. Do not use our Electric Scooter if you have any existing physical or mental condition that would prohibit you from safely operating the Electric Scooter.

d. Do not violate any applicable federal, state, or local law.

e. You are prohibited from using our Electric Scooters for any unlawful purpose or in any unsafe way. We want a safe experience for you and those around you in your community, and that means we have some rules. There will not always be a designated place for you to ride, such as a bike lane for E-Scooters or bikes, so exercise caution when riding in areas with cars and other traffic (we are not responsible for the actions of drivers, pedestrians, or other third parties).

f. You are also not permitted to use our Electric Scooters to participate in activities beyond its intended use. Some of these are obvious, but for example, no racing, stunting or trick-riding, riding up or down stairs, and DO NOT take any Rodanthe Ride Electric Scooter off-road or through any amounts of salt water and sand. Any of these uses will damage our Electric Scooters or cause serious injury or death to you or someone else. You may not use our Electric Scooters for hire, reward, or for any other commercial use such as advertising, ride-sharing or food delivery. Do Not tamper with, vandalize or try to gain unauthorized access to our Electric Scooters. And of course, do not use our Electric Scooters in connection with the violation of any law.

3. Rules on Helmets

​We recommend that you wear a helmet any time you use any of our Electric Scooters. It should be sized, fitted and fastened per manufacturer instructions. Helmets and other protective gear are not guaranteed to prevent personal injury. Helmets are required by law in some areas, so definitely wear one if those laws apply to you. If you choose not to wear a helmet and are injured as a result, we are not responsible. You must sign a Helmet Release for if you refuse to wear the helmet provided.

4. Safety Checks

You are required to perform a safety inspection on the electric scooter and helmet before each use, including all of following:

a. Did you check its general condition (body, frame, wheels, tires, etc.)?

b. Do all adjustable straps function and clasp on the helmet?

c. Are you able to adjust the helmet to fit securely?

d. Does the helmet show any signs of damage?

e. Do the electric scooter’s brakes and lights work?

f. Is the battery charged?

g. Is there any other sign of damage, unusual or excessive wear or is maintenance needed?

Something could have happened to the Electric Scooter since its condition was last checked, and we rely on you to inspect the electric scooter before each use and report any suspected issues. If you notice any issues identified above, or any others, during your safety inspection DO NOT use the electric scooter. Please report any issues immediately, contact our office via phone or email and request another Electric Scooter or helmet instead. If you notice something during use, stop your trip as safely as you can and as soon as possible. If you do not report these issues, we may have to attribute them to you, including holding you responsible for any associated costs, so please tell us of anything you see.

h. When not in use, your E-scooter should always be kept in a safe place and out of the elements.


5.Battery care/ Charging.

​Unless we expressly permit you to do so (e.g., charging electric scooter with provided charger connected to a safe functional outlet), you should not handle, remove and/or otherwise tamper with the batteries (whether removable or not) on any Rodanthe Rides Electric Scooter. All E-scooter rentals include a charger. We require E-Scooter batteries be fully charged on pick up day. If the Electric Scooters are not fully charged you will incur a $10 charging fee.


6. Use of Locks.

​Please do not lock up any Electric Scooters with a lock that is not ours, we will not be able to unlock it. Please do not leave an Electric Scooter in a manner or location which we cannot access. We may charge you up to $700 if we are not able to retrieve any Electric Scooter due to your actions.


7. Weight Limit

The weight limit for scooters is 240 pounds. This maximum weight includes you and all items placed or carried by you.


8. Replacement Cost

​If you damage an Electric Scooter or if the Electric Scooter is considered lost or stolen under the terms of our User Agreement, you will be responsible for the associated costs. The replacement cost of a scooter is up to $700.

Please do not hesitate to ask, we can provide instruction for our rental scooters at any time. If upon initial inspection you find the Electric Scooter to be inoperable, please call us immediately.


-STANDARD DELIVERY-

​Normal delivery hours are listed below:

9AM for 10AM rentals, 10AM for 11AM rentals, 11AM for 12PM rentals, 12PM for 1PM Rentals, 1PM for 2PM rentals, 3PM for 4PM Rentals, and 4PM for 5PM Rentals. E-Scooter deliveries are made between 9AM and 6PM on your scheduled delivery date.

All items are placed underneath the cottage, safe and out of the weather. Items may also be placed near the cottage entrance. Upon departure, please place all items in the same location as the delivery placement. All items must be returned clean, fully charged, and in good working order. A $10.00 SERVICE CHARGE will be made for items returned unclean and $10.00 SERVICE CHARGE will be made for uncharged batteries.

There is a $10 delivery charge for all electric scooters, included in rental price.

​-CANCELLATION POLICY-

Weekly rental orders cancelled 8 or more days before rental start date (for any reason) will be given a 100% refund.

​Weekly rental orders cancelled (for any reason) within 7 days before rental start date, will be given a 50% refund.

Daily rentals are not eligible for any refunds.

No refunds will be issued due to inclement weather.

No store credits or gift cards will be issued in place of refunds.

If rental item(s) has been delivered to customer, no refunds will be given.  We will gladly trade for another Electric Scooter.

After delivery has occurred, delivery fees are not refundable under any circumstances.

Refunds are ONLY administered by management of Rodanthe Rides Electric Scooters; customers must contact a manager for all refunds.  Cancellation refunds will be issued within 30 days of receipt. An email confirmation will confirm your refund; please remember debit (and some credit cards) post with a delay, as per customers’ bank policies.


-HURRICANE / STORM POLICY-

In the event of a mandatory evacuation from the area, any requested refund will be issued within 30 days after the evacuation has been lifted by Dare County Emergency Management.

Weekly rental orders cancelled (for any reason) within 7 days before rental start date are eligible for a 50% refund.

​Customers who possess their weekly rental items for 1-3 days before evacuation are eligible for a 50% refund.

Customers who possess their weekly rental items for 4 or more days before evacuation are ineligible for a refund.

Once performed, delivery service is not refundable.

In the event rental equipment that is not recovered at time of pickup (from delivery service) no refunds will be issued and the full cost of the scooter will be charged up to $700.

All refunds are ONLY administered by management of Rodanthe Rides e-Scooters. Customers must contact a manager for all refunds.  Cancellation refunds will be issued within 30 days of receipt. An email confirmation will confirm your refund; please remember debit (and some credit cards) post with a delay, as per customers’ bank policies.

Trip Insurance is strongly encouraged. 

Rodanthe Rides LLC, Electric Scooters, AND ITS’ EMPLOYEES ARE NOT RESPONSIBLE FOR ANY DAMAGE THAT MAY OCCUR TO THE INTERIOR OR EXTERIOR OF YOUR VEHICLE DURING LOADING, UNLOADING, OR TRANSPORT OF ANY RENTAL EQUIPMENT.

ALL EQUIPMENT IS USED AT LESSEE’S RISK.

The Lessee acknowledges that Lessee has inspected the equipment and has determined that same is in good condition and suitable for the purpose for which it has been leased. The Lessee shall only use the property in the manner for which it is designed and intended to be used. Lessee recognizes that the property is being received AS IS and WITH ALL FAULTS. LESSOR MAKES NO REPRESENTATIONS, PROMISES, OR WARRANTIES, EITHER EXPRESSED OR IMPLIED, CONCERNING THE MERCHANTABILITY, SUITABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF THE PROPERTY. LESSOR EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER ARISING FROM STATUTE, COMMON LAW, CUSTOM, OR OTHERWISE.

Lessee acknowledges and accepts the User agreement and User Rules for electric scooters.

Lessee assumes all responsibility for equipment while out of possession of lessor and promises to return such equipment to the lessor in as good condition as it was at the effective date of the lease. Lessee shall be liable for any loss, theft, damaged or destruction of leased property (Scooters, Batteries, Helmets, Locks). All equipment lost or damaged beyond repair will be paid by the lessee at regular replacement cost. All damaged equipment which may be repaired will be repaired by the lessor, on return thereof and the cost for such repairs shall be paid by the lessee. Accrued rental charges cannot be applied against the purchase price or cost of repairs of such damaged or lost equipment. Scheduled rental rates begin when the equipment leaves our store and continues until returned. Lessee shall indemnify and hold Lessor harmless from any and all claims, damages, or proceedings (including all costs, expenses, and attorney’s fees) related to or arising out of Lessor’s use or possession of the equipment. This equipment shall be used by the Lessee only. This writing contains and constitutes the entire agreement between the parties. This lease agreement can only be modified by written agreement signed by both Lessor and Lessee. The Lessee represents that Lessee is at least eighteen (18) years of age and under no disability which will prevent Lessee from entering into this agreement. Lessee agrees not to part with or assign this lease or the equipment without the written consent of Lessor
